On November 17, 2025, the City Council approved the second reading of the updated Rent Stabilization and Eviction Control Ordinance. The updated ordinance will take effect on January 1, 2026. The City of Pomona has adopted Ordinance No. 4359 (“Ordinance”), updating its Rent Stabilization and Eviction Control Ordinance. This Ordinance takes effect on January 1, 2026, and replaces previous tenant protection measures.
Key Provisions
- Residential rent increases are limited to 5% per year. Only one rent increase is allowed in a 12-month period, and it cannot exceed the allowable rent increase in effect for that period.
- Tenants may dispute ineligible rent increases and other violations of the Ordinance by filing a Petition of Noncompliance.
- Landlords may petition to increase rents above the published rate to maintain a fair and reasonable return with respect to operation of the property by filing a Fair Return Petition, or a Capital Improvement Petition.
- Unlawful Detainer Filings: A copy of any unlawful detainer (eviction) action filed in court must be submitted to the City within ten (10) calendar days after serving the tenant. 3-Day Notices are no longer required for submittal to the City.
- Landlords must have an At-Fault or No-Fault reason to terminate a tenancy. For terminations that qualify as No-Fault, landlords must provide financial relocation assistance.
- The Ordinance contains exemptions for certain units, including units expressly exempt under Costa-Hawkins Rental Housing Act, the California Tenant Protection Act, or any other provisions of state or federal law.
- Permanent Ordinance 4359 repeals and replaces Urgency Ordinance Nos. 4320 and 4329.
